MEMORANDUM IN SUPPORT OF MOTION FOR ATTORNEYS' FEES AND REIMBURSEMENT OF COSTS Plaintiffs and class representatives Michael Clark and Kentucky Air Tool, Inc., individually and on behalf of all other class members, for their Memorandum in Support of Motion for Attorneys' Fees and Reimbursement of Costs, state as follows: INTRODUCTION AND BACKGROUND After more than three years of concerted effort and more than two years after filing this lawsuit, the Plaintiffs in this action have succeeded in obtaining complete relief for the more than fifty thousand class members in Kentucky who were overcharged during a six year period. If the Stipulation of Settlement Agreement and Release filed in this case on May 16, 2007 the "Settlement Agreement" ; [#92] is approved by the Court, the classes will receive one hundred percent of their money back, plus interest at the statutory rate prescribed by KRS 131.183. This multi-million dollar recovery is due to the persistent efforts of Plaintiffs and their counsel. Consequently, Plaintiffs are entitled to reimbursement of costs and to reasonable attorneys' fees pursuant to the Common Fund Doctrine established over a century ago by the United States Supreme Court and.
Zania's mostfrequent cause of admissions to hospitals and out-patient attendances3. The rankingwasfound tocompare rather well with only minor differences as shown, fevers, respiratory diseases and gastrointestinal disorders were foundto rank highon the !Ists. Table 2 shows that relatively, Iringa region had more gastrointestinal disorders, more obstetric and gynaecological disorders and more leprosy than Arusha which had a higherrelativefrequency ofrespiratory diseasesandfevers. Table3and4s ow diseasepattern as seen in fringa and Arusha respectively. The tables clearly showthat the pattern inthese two regions issimilar.Somedifferences howeverdo exist. For example respiratory diseasesin Arusha have the lowest frequencyin the age group10-19years where else in lringa it is lowest in the 20 - 29 year age group. In Aruha Obstetric and Gynaecologicai disorders show the highest frequency in the age group.20 - 29 while in lringa in the 30 39 year age group. Table 5 showsthat 73.5% of all the sick consulted modern health services while 11.6% consulted traditional health services.Itcanalso beseenthat6.2% ofthe sick did not consult health services. In table 6 and 7 the educational status of the heads of households is categorised. The first category comprises of those who had never had anyform offormal education, the ond those who had either attained adult literacy education or primary IV education, and the third, those who had either attained primaryVII or secondary school form IV education. The results show that the level of education of the head ofhousehold did notinfluence theutilization. Figure 1 -3 show thedifferencesin utilization by age and place. Modern health service-utilization was the highest in both regions but it was higher in Arusha than lringa. There was some tendency forutilization to decline with age in both regionsbut this couldbe a cohorteffect. Traditional health service utilization was slightly higher intheolder agegroups, Iringa having higherutilization rates thanArusha. Older agegroups tendedtoutilizeboth services morethan the younger ones and Iringa utilized both services morethan Arusha. Figure4showsthatthereis asignificant difference in the health service utilization rates between Iringa and Arusha butvirtually no difference betweenthesexes. Figure 5 and 6 show utilization rates bydiseasecategory and place. Although utilization rates are higher for modern than fortraditional health servicesthe orderof utilization by disease category is quite different. Diseaseslike paralysis, obstetrics and gynaecoiogicalconditionsand unknown diseases ranked high intraditional healer utilization whilethey ranked low in modern health service utilization and

The rapid rise of medical and pharmaceutical expenditures has become a critical barrier to health care for the poor and its control is a key objective for health policy makers Bloor and Freemantle 1996; Centre for Health Statistics and Information 1998; Wu and Yang 1999; Maynard and Bloor 2003 ; . China is no exception. Pharmaceutical expenditures have grown at a rate well above overall economic growth for the past two decades Wei 1999 ; . Drug expenditure per capita in real terms increased from 36.6 yuan in 1990 to 184.3 yuan in 2001 US$1 8.2 Chinese yuan ; , an annual rate of increase of 15.7% Zhao et al. 2003 and griseofulvin.

Many GABAA receptor modulators exhibit clear subunit selectivity Olsen and Macdonald, 2002 ; . GABAA receptor pharmacological studies have focused on "structural" determinants of modulators, such as the subunit dependence of benzodiazepines Sigel and Buhr, 1997 ; and the proposed "transduction" element at the outer mouth of the second transmembrane domain TM2 ; Wingrove et al., 1994; Stevenson et al., 1995; Halliwell et al., 1999; Thompson et al., 1999 ; . "Knock-in" mutations of the benzodiazepine binding site emphasized the importance of characterizing the isoform preferences of allosteric modulators Rudolph et al., 1999; Low et al., 2000; McKernan et al., 2000 ; . In addition to the rich isoform-specific pharmacology of GABAA receptor channels, there is clear evidence that biophysical properties, such as desensitization and gating efficacy, also depend on subunit composition Fisher and Macdonald, 1997; Haas and Macdonald, 1999 ; . One of the potential confounding factors associated with investigating subunit-specific pharmacology is that "functional" differences among isoforms, as opposed to simply the presence or absence of modulator binding sites, may play a significant role in determining pharmacological profiles. Therefore, the observation of subunit-dependent modulation might in some cases be an epiphenomenon, in which the, for example, neurontin.
Important to distinguish between a capacitative calcium entry mechanism triggered by store depletion, or a loss in calcium homeostasis, possibly due to an effect of the drug on ion channels and transporters. The experiments described in this work address these two possibilities and begin to elucidate the cellular basis of AMD toxicity and micronase.

If you buy certain medicines within 20 days of having bought them previously, a special rule called the `Safety Net 20-day rule' may apply. In such cases, the cost of the medicine will not count towards your Safety Net tally, or you will have to pay the usual amount for it if you are already using a Safety Net Card. The rule applies only to selected PBS medicines used long-term for chronic conditions where a prescription is intended to last one month. The rule does not apply to medicines intended for shortterm use eg antibiotics ; . The rule is designed to prevent people on a Safety Net Card using their card to hoard additional supplies of their medicines at the end of a calendar year.

Vaccination of residents of care-homes against influenza can be effective in preventing respiratory illness, admissions to hospital, and death. The immune response in the elderly, however, is reduced. Protection against flu is only 50% to 70%. Residents are vulnerable to flu outbreaks even when vaccination rates are high. These investigators hypothesized that vaccination of the staff would reduce transmission to residents, and therefore reduce residents' influenza-like illness, and associated deaths and health service use. Randomized controlled trial followed 44 large private-chain UK elder-care homes during 2 flu seasons--2003-04 and 2004-05 Total residents 2604; total staff 1703. ; All residents had been routinely offered flu vaccine. The homes had not routinely offered vaccination to staff members. Randomized to: 1 ; intervention homes, and 2 ; matched control homes. Vaccination for flu was offered to the staffs of the intervention homes, but not to control homes. Vaccine coverage of full time staff Intervention homes 48% Control homes 6% Vaccine coverage of part-time staff 21% 4.
History of Medicine Days is an annual event that gathers medical students from across Canada to present brief papers on history topics of their choice. This year 54 papers were presented by students from the medical schools at Memorial, Dalhousie, Queen's, Western Ontario, Manitoba, Saskatchewan, Alberta and Calgary. The titles testify to the wide range of interest and concerns of young physicians in the year 2002. They cover events from as far back as history is recorded, but concentrate on themes from the 20th and 21st centuries, and raise issues relevant to everyday practise and the meaning of modern medicine both as a profession and as a healing art. Presentation styles ran from the humorous and detached to the engaged and polemical. Dr. Larry Clein's charming and insightful lecture, "Harvey Cushing: You Should Have Been a Rocket Scientist", gave a balanced judgement of a famous neurosurgeon. The surrounding social activities stimulated many lively discussions which we hope will continue through the future careers of the participants. The essays in this volume cannot capture the spirit of the event, the impression the students made with their presentations, or all of their passion about issues in the history of medicine, but they do convey the depth of their research, the range of their interest, and their skill at writing. History of Medicine Days owes its existence to the efforts of many people. Each of the students devoted many long hours stolen from a very pressing medical school curriculum to the research and writing of these papers, and to the preparation of their oral presentations or audio-visual material. Many of them were inspired or assisted by volunteer faculty members whose enthusiasm for the lessons to be learned from history can drag them also away from their day-to-day commitments. We are most grateful to Naomi Anderson, Dr. Larry Clein, Dr. Dawna Gilchrist, Dr. Geoffrey Hudson, Dr. Otto Rorstad, Dr. Peter Warren and Dr. Jack Williams for devoting the entire two days to judge the event. Carolyn Taylor managed the website, ensured that all the administrative details were very smoothly taken care of and spent many hours and considerable effort of assembling the Proceedings itself. Student volunteers Melanie Marsh, Agnieszka Wojciechowski, Ann Wormsbecker and Susan Poelman organized billets and social events. The event and the publication of the Proceedings would not be possible without substantial financial support the Alberta Medical Foundation, the Hannah Institute, and the Faculty of Medicine at The University of Calgary to whom we are very grateful.
